Health Buddy Terms of Service

Effective Date: September 15, 2025

These Terms and Conditions (“Terms”) govern your use of the Health Buddy mobile application (“App”), provided by Health Buddy Inc. By using the App, including its AI-powered chat feature, you agree to these Terms.

1. Purpose of the App

Health Buddy helps you better understand your health and wellness by providing general information based on your input. The App is a tool for insight and education, not a medical service or diagnostic platform.

2. Age Requirement

You must be at least 18 years old to use the App. By using Health Buddy, you confirm that you are 18 or older and legally able to consent to how your data is handled as described in our Privacy Policy.

3. Use of the Chat Feature

The App’s chat feature uses AI to provide general health and wellness information. Access to chat is gated by a consent popup; by proceeding you confirm you are 18+, acknowledge the App provides information only and not medical care, and accept the Terms and Privacy Policy. The chat does not provide authoritative diagnoses or treatment plans.

4. Camera & Photos

The App may ask you in chat to take a live photo when a visual symptom is described. You can also use the dedicated camera tool to capture images of product labels, meals, skin, dental, stool, etc. By capturing a photo you authorize us to transmit it, encrypted, to our AI solely to generate feedback and, for paid users, to store it locally on your device (chat photos in your Chat Archive, dedicated camera tool photos in your Saved Results). These local archives are not included in device backups (iCloud/iTunes) and you can delete them at any time. For free users, photos and related results are deleted immediately after feedback and are not stored. Image analysis is informational only and not medical advice.

5. Not a Substitute for a Doctor

Health Buddy is not a licensed medical provider. It does not diagnose, treat, or cure any medical conditions. Always consult with a qualified healthcare professional for medical concerns or decisions.

6. Not for Emergencies

The App is not intended for emergency use. If you are experiencing a medical emergency, contact emergency services immediately.

7. Your Responsibility

You are solely responsible for how you use the information provided by the App. We do not guarantee the accuracy, completeness, or effectiveness of any content. All information should be treated as general guidance only.

8. Privacy

We take your privacy seriously. Please refer to our Privacy Policy to understand how we handle your information.

9. Updates and Changes

We may update these Terms periodically. If we make significant changes, we will notify you within the App. Your continued use of the App after such updates means you agree to the revised Terms.

10. Ownership

All content, features, and technology within the App are owned or licensed by Health Buddy Inc. You may not reproduce, modify, distribute, or otherwise use any part of the App without our prior written permission.

11. Limitation of Liability

To the maximum extent permitted by law, Health Buddy Inc. is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the App or reliance on its information.

12. Limited License

Health Buddy grants you a personal, non-transferable, revocable license to use the App for your own non-commercial health-information purposes.

13. “AS IS” Disclaimer & Liability Cap

The app is provided “as is” and “as available.” Our total liability, if any, is limited to the amount you paid for the app in the preceding 12 months.

14. Subscriptions & Refunds

Subscriptions are billed monthly through the Apple App Store and can be canceled at any time in Settings > Apple ID > Subscriptions. Refunds are handled solely by Apple under its policies.

15. Governing Law & Arbitration

These Terms are governed by Delaware law. Any dispute will be resolved by binding individual arbitration (AAA Rules), except either party may bring an individual claim in small-claims court. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@healthbuddy.care. Class-action participation is waived.

16. U.S.-Only Service

The App is offered for use in the United States only.
